1) Acceptance of Terms
By accessing or using mtfranklin.com (the “Site”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Site.

Mt. Franklin Insurance (“we,” “us,” “our”) provides insurance information and the ability to request quotes and services. Coverage is available only where we are properly licensed and only as set forth in an issued policy.
3) Informational Only — Not Advice
Content on the Site, including any blog posts, is for general information and educational purposes only and is not legal, financial, tax, or insurance advice. Your insurance needs are unique; consult a licensed professional for guidance.
4) SMS Terms of use
By “Opting In” to or using a “Text Message Service” (as defined below) from Mt. Franklin Insurance, you accept these Terms & Conditions.
This agreement is between you and Mt. Franklin Insurance or one of its affiliates. All references to “Mt. Franklin Insurance,” “we,” “our,” or “us” refer to Mt. Franklin Insurance, 122 Thorn Avenue El Paso, TX 79932.
DEFINITIONS
“Opting In,” “Opt In,” and “Opt-In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.
“Text Message Service” includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).
CONSENTING TO TEXT MESSAGING
By consenting to receive text messages from us, you agreed to these Text Messaging Terms and Conditions, as well as our general terms & conditions (also on this page) and Privacy Policy, incorporated herein by reference.
E-SIGN DISCLOSURE
By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.
MT FRANKLIN INSURANCE TEXT MESSAGE SERVICE PRIVACY POLICY
We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but isn’t limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Nonetheless, we reserve the right always to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn’t intended to modify our general Privacy Policy, incorporated by reference above, which may govern the relationship between you and us in other contexts.
COSTS OF TEXT MESSAGES
We do not charge you for the messages you send and receive via this text message service. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.
FREQUENCY OF TEXT MESSAGES
This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as by sending a HELP request).
You may obtain HELP by responding HELP to any text message. You may also email info@MtFranklin.com to receive support at any time.
OPTING OUT OF TEXT MESSAGES
If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message.
5) Quotes, Applications & Claims Submissions
Forms on the Site allow you to request information, quotes, or assistance in starting a claim.
No coverage is bound and no policy changes take effect by using the Site or submitting a form. Coverage is effective only when confirmed in writing by us or your carrier and subject to all policy terms and underwriting approval.
You represent that information you submit is accurate and complete. Do not upload or include sensitive personal information (e.g., SSN, driver’s license, medical or bank details) unless we expressly request it through a secure channel.
By submitting a form, you authorize us to contact you using the methods you provide (e.g., phone, email, or text/SMS). Message/data rates may apply. You can opt out as directed in those messages.
6) Privacy
Our collection and use of information is described in our Privacy Policy (available on the Site). By using the Site, you consent to those practices.
7) Intellectual Property
The Site and its content (text, graphics, logos, and other materials) are owned by or licensed to Mt. Franklin Insurance and protected by applicable laws. You may view and print content for personal, non-commercial use. Any other use requires our prior written consent.
8) Acceptable Use
You agree not to: (a) use the Site for unlawful purposes; (b) attempt to gain unauthorized access to the Site or related systems; (c) interfere with Site operation or security; (d) copy, scrape, or harvest content or data except as permitted by these Terms; or (e) submit harmful code.
9) Third-Party Links & Tools
The Site may link to third-party websites or use third-party tools. We do not control or endorse those sites or services and are not responsible for their content, policies, or practices. Your use of them is at your own risk.
10) No Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MT. FRANKLIN INSURANCE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
12) Indemnification
You agree to defend, indemnify, and hold harmless Mt. Franklin Insurance and our officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your submission of information via the Site.
13) Governing Law & Venue
These Terms are governed by the laws of the State of Texas, without regard to conflicts of law rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Texas for any dispute not subject to informal resolution.
14) Changes to the Site or Terms
We may update the Site and these Terms from time to time. The “Last updated” date reflects the latest changes. Continued use of the Site after changes means you accept the revised Terms.
